Well it would matter. Every case is different, and we live in an age of litigation. The best litigators win cases a lot of the time.

The common thread here is that people are relating to their own experiences which doesn't give a balanced view, because those views are then borne out of bad experiences. Every case is different, and, for sure, if there's a vehicle which "Shouldn't" be there, there is at least some portion of blame to be attached to the driver who was negligent enough to leave it there. Might only be a small part, but the best litigators exploit any small loophole or piece of mitigation, so don't be fooled into thinking that anything is an open and shut case. Which is another reason why you shouldnt admit liability.
