The girl and/or driver (dependant upon age), could face a charge for the failure to wear a seat belt (up to 500 pounds per person carried unlawfully, if they are minors I believe).

I would also assume insurance would be void if an accident occurred, so this would be taken in to account too.

If these are children being carried, they will throw the book at the driver, as they are responsible for their safety.
