I also have had the whining noise as per your problem #1. Jeroen1000's similar experience was discussed here.

Engine sound question

The noise only ever seemed really noticable before the engine had warmed up.
I have now done well over 4000 miles and rarely get the whining sound anymore. Its not that i have got used to it.
I think this was also described as a "feature" of the car by Jeroens dealer

However i will mention it when i get my car serviced if it has not completely disappeared (along with the 3rd gear issue

which also seems to have improved)
