If the cops caught you with 4 in the back...
Not sure if this is the right area to post this in. If not, sorry, mods please move to where more appropriate. Right then, my girlfriend's daughter is involved in a drama group activity, during the school Easter holidays, in a town about 25mins away from us (including quite a bit of motorway driving). Everyday one of the parents has to run a gang of 12 year old girls down there. Some of the parents are taking 5 down, with the extra body laying across the 3 people sat in the back (sometimes in a 3 door Micra!!!). I having refused to this & will only take 4 down. What I was wondering is what could you expect from the coppers if they caught you with that 5th passenger? I immediately thought someone on here would be clued up enough to know. I'd imagine it'd be more serious than the 3 points & fine for that person not wearing a seatbelt. Anyone?

Legally you can only carry the number of passengers you have seat belts for! I believe you can get fined for this, particulaly if the passengers are minors as the responsibilty falls with you. As you mentioned the most serious problem besides the legal one is the safety aspect, you really wouldn't want to know what would happen in a high speed collision! Regards Chris |

> CD30 Driving without due care and attention, 3-9 points + Fine > CU50 Causing or likely to cause danger by reason of load or passengers 3 points + Fine The girl and/or driver (dependant upon age), could face a charge for the failure to wear a seat belt (up to 500 pounds per person carried unlawfully, if they are minors I believe). I would also assume insurance would be void if an accident occurred, so this would be taken in to account too. If these are children being carried, they will throw the book at the driver, as they are responsible for their safety. ATB, Tom |

Agree with you Unknownsoldier.
Same rules apply here in France, not the same fines but the spirit is the same. Plus you're right, insurance company will cover you only if you are driving as established by the driving rules applicable. If not you are personnaly responsible for it, wich is not very well knowed I assume. |

Personally I would be most unhappy if that was a kid of mine being carried in such an unsafe way. Tom No insurance etc. is: IN10 Uninsured vehicle, 6-8 points, TT99 Totting up under points accrued - no points but loss of license, so taking maximum for everything, I don't too many magistrates would be lenient in a case like this; IN10 8 CD30 9 CU50 3 Failure to wear seatbelt (minor) 3 23 points - Ban! possibly exceeding 2 years due to severity of case. I'd throw the book at them, if I were on the bench, especially if they were caught/had an accident on the motorway. T Last edited by Unknownsoldier; 1st April 2008 at 15:27. |

You may recall last year on the M40 Oxfordshire, a lady was bringing several kids back from a party, she had too many passengers in her car and crashed, several fatalities occured, they reckon it would not have been so bad if she was not overloaded!!

Even though breaking the law is serious and not anything we would recommend on this forum, the safety aspect of this is much worse.
The safety aspect of this should make you say no even before considering what to expect from the police! |

A little kid laying across the 3 in the back...! For a parent to actually let that happen is disgusting! Like when you see parents with their babies sitting on their lap in the front seats on the motorway!

Back before rear belts were standard fit this was pretty common - I remember as a kid being one of four in the back of a various cars (including a Mini Metro - a bit of a squeeze!) without anyone batting an eyelid. It is good how the various road safety initiatives has changed the way people think as well as the way cars are made.

Since hearing about my refusal, the others are now refusing to carry 5. Although, I thinks it's more to do with convenience than legal & safety reasons. You know- "Well, if he isn't then neither am I!".
