I've lost all faith in our justice system
It looks like you can do anything you want then appeal and either you will be let off or, as in this case, have your sentence reduced - BBC NEWS | England | Manchester | Sentence cut on glassing attack

The appeal judges also accepted that Kee's personal mitigation that the offence was not premeditated and was totally out of character for Kee, who had no recollection of the violence and had clearly shown remorse.
You hear that a bit too much And that picture of the victim looks awfull The fact she says she doesnt recall anything of the violence is a reason more to just let her serve her full sentence. I dont know how its with you guys in england but over here, overpopulation in prisons is a big issue and sees a lot of criminals escape their punishment. Hell, the belgian government even bought a dutch prison to 'stack' our criminals. It doesnt look good for the future i fear... Last edited by Woette; 11th June 2009 at 19:01. |

Unfortunately, this is what happens when emotions get the better of the facts. It's a sad fact that there are tariffs in place for sentencing, and the problems occur when the original sentences are set too high. Had they been set correctly in the first place, the outcry about the appeal wouldn't have happened even if, initially, they thought it was too low.
Sure, we might think that a sentence or punishment isn't as much as it should have been, but in truth, setting an over the top sentence is a bit of an emotional time bomb for the victims. There are many things to consider when setting a sentence, and it's not all based on that actual crime which has occurred. There are pre sentence reports which take all kinds of things into account, not least any remorse shown, previous good character etc. For example, in the first scenario, despite seeing the injuries caused to the victim, would it be right that the offender received the same sentence as someone who'd done that for the fifth time? For the victim and their family, perhaps so, but in terms of the justice system, who deal with the case from an objective point of view, there has to be a difference between the result of and argument getting out of hand, and a convicted thug who does that kind of thing on a regular basis. |
