Speak to your solicitor re the fence. It's a civil matter, no need for Police. Solicitor will guide you and hopefulyl have the fence issued resolved, as you say its co-owned.

The local council will also be able to help with regards how high a fence is allowed to be ownership rights and how you go about getting him to lower it.
Our neighbours built a conservatory thats elevated up so they look over our fence straight into our garden, they are perfectly within their rights to do so as its not over a certain square footage, it can be as high as they wanted! The council advised us the height of fence was already as high as allowed, but suggested that we could build a "structure" as high as we like as long as it's not attached to the fence. My bf built a pergola with bench, the back is trellis which we have covered in bamboo screening. Looks good this side and they and we are happy that neither of us has to see the other! I know this is of little help to your situation J but perhaps you could do something similar to mask the fence? Last edited by Obo; 16th May 2007 at 12:21. |
