Ok to be honest i have had enough with my Civic - in 3 months its been back to the garage 12 times. Had so much work done - including new shocks, new light system, new spoiler - leaking interior! very bad! I have had the car 3 months and want to return it! its an 06 plate and no way should it have these defects! The suspension is very poor still and its constantly creaking and banging - whats your advice? I have formally asked for an exchange -

I would give it to them with a list of outstanding faults and demand they be fixed, and threathen legal action if they don't get it all done in a reasonable time. Remember it is the dealer, not Honda UK you need to deal with.

How long have you owned the car now
three months?? If the dealer is saying they wouldn't accept it take it to the dealer and demand a refund or replacement advise them that you will be speaking to trading stds aswell if you do not get a satisfactory answer!!!! It is known that early 06 cars did have quite a few issues |

The Sale of Goods Act 1979 ammended to the Sale and Supply of Goods to Consumers Regulations 2002 gives you a number of rights, including the ability to reject faulty goods with a reasonable timescale (and it sounds like you have maintained this by raising the issues, allowing time for the dealer to fix and thus being reasonable yourself).
Do you have legal cover with your car or any other of your insurances? If you do call them and discuss the issue as they will advise you of what letters to write and may even draft a letter for you. It is surprising what effect actually quoting the law has. Honda may simply agree at that point and change the car, or, they may wish to contest the rejection, but at least you will have the foundations in place for a sound case. Hope this helps. |

luckily i am a trainee solicitor - and have starting the ball rolling - i have a meeting with them this week to discuss the matter! I have put Honda on notice to my claim. Demanding an exchange.
I have had 4 shocks replaced (still very poor handling), water leaks, new lighting system in the rear of the car, new spoiler (due to leaks)...not good! |

I'd be interested to see how Honda deal with a claim on a second hand car, as I think you mention you are looking for an exchange (I presume for another second hand one).
There is an obligation on the dealer to repair, and if a repair is not possible then they should refund (SoG). So that's why I'm asking about stuff that they cannot repair. You've had new dampers, but what exactly is the outstanding fault? And I assume that it's not just the dampers that are "unfixed", so I'll patiently ask again: Can you list the currently unfixed faults? |

Reject the car under the sale of goods act , as it is not fit for purpose & do it now as after 6 months you will only get a % of your cash or a replacement. Iam doing the same with my Mini Cooper S 07.

Thanks for that skff. Just wondering... if the handling is that bad that the car is sliding (the VSA I imagine is working fine - it is designed to come on when the car slides), and the car leaks... if the previous owner crashed (or bumped) it. A quick proper geometry check (a good tyre place will be able to do this) will instantly confirm whether this is the case. The dampers alone will not cause this problem, if they are not working you will bounce like you are in a bouncy castle and if the dealers have already replaced them then really that rules them out.
Could it be that the dealer knows that the car has been bumped, and is not owning up? Or maybe they are innocent and it's news to everyone. If the geometry is correct, it should handle fine. If you get it checked and the car is bent, then the dealer will give you a full refund immediately. The leaking doors may also be the result of a bump. There are drains in the bottom of the doors (if these block then the door fills with water), but these drains should drain to the outside world, unless the car is bent and/or the main door seal is in the wrong place (after repair or respray). You may even want to consider getting an expert third party (AA or similar) to do a report; they can tell you very accurately if the car has a "history". |
