Have to admit may speak to them about the new handbrake seeing as it seems they have already replaced at least one. Why should I have to wait if the car is in the garage you would think be easier to do the lot all in one go. I cant wait for this whole nightmare to be over so can go back to enjoying my car. At the moment i am so nervous of parking the car on a slope or even when at junctions or at lights. I will be sticking with this website I think and will have to get a sticker for my car, If my mate hadn't found this site I expect I would have been paying out for the damage. Thank you for the support shown to me, reading all the posts on here have just spurd me on even more. |

Hi everyone,
new to the forum, but I see I am not alone. In the Summer I had my new Civic for two months when it rolled back in the work carpark (30 minutes after I'd parked it) into the path of a lorry that was entering (ouch!). Over £2,000 damage and the claim went against me. When it went to the garage, the mechanic told me they were just fixing up another new Civic where the same had happened - he said he suspected there was a handbrake problem but at that point Honda were denying it. Now I get the recall letter! I was always taught to put the handbrake on using the button (and a lot omy colleagues agree). I do leave car in gear if on a major incline, but since the incline in my work carpark is very small I don't tend to (I do now!) So do I have a case against Honda? RAC who insures me are looking into it as we speak. I think they are trying from 3 points: 1. Paragraph 3 in the recall letter is Honda's let out clause by telling you to refer to the manual. However, although not told to do it that way in the Civic manual, putting the handbrake on with the button down is an acceptable method of applying the handbrake that a lot of us use. The manual does not highlight any of Honda's current concerns that are in the recall letter and no one one warned me about it when I bought the car in May. 2. If as they suggest putting the handbrake on without using the button is the only acceptable method of applying a handbrake then why in paragraph 4 do they admit their current guidance is an inconvenience and why do they apologise for that inconvenience in the last paragraph? 3. If my accident was my fault for not following Honda's manual instructions to the letter why are they suggesting I have to bring the car in for a handbrake upgrade? My accident would be completely down to my stupidity wouldn't it? Have many of you had accidents caused by this handbrake failure? How are you taking it forward and has anyone had any joy yet? I agree with another member that behind the scenes something must have happened to spook Honda in this way and let's hope that we who have had accidents can now defer the blame to Honda. Also if TC is out there I also have suddenly developed an annoying rattle under the dashboard like a coin rolling around. Anyone else had this problem and what is it? |

Frankenstein, I think it would be useful for you to read all of TruckerEm's posts, if you haven't already. Similar thing happened to her and Honda have agreed to pay for the repairs at last.

I would agree with Dimplyred. Keep records of your contact(s) with Honda UK or your local dealer and retain all receipts etc. It appears Honda UK are admitting liability, or maybe just to those that are persistent in their claim. Good luck and let us know how you get on. I have a feeling that more cases like yours will now surface. |

frankenstein,
About 1.3% of people have suffered damage that cost money to fix as a result of the handbrake flying off. I'm sure that if you can show that the handbrake had gone to the off position, then you will have a good case. |

Am I to understand that some roll backs are due to the brake pinging off to the off position and others due to the brakes not engaging in the on position if you apply the brake using the button?
Thanks for the pointer Pottsy. My handbrake was off when I found the car after the accident, but how do I prove that the brake pinged off to the off position causing the accident? Couldn't Honda lawyers counterract that by saying maybe I didn't apply the brakes in the first place? How sound is the pinging off issue to use in your defence? (I'm sure I did apply the brake!!) It was the fact that a third party noticed the brake was off and told the other driver that caused my insurance company to close the case against me without a second thought. So do I raise this in my fight or just battle on the other issues I mentioned in my earlier posting? Anyone else have thoughts on this? |
