Just thought ide let you know about my second experinance with Adrian Flux.

Basically an idiot cut down a tree just as I was driving past and it hit my car. The guy admitted liability and all that.

Rang AF to pursue my claim, they said as it didn't involve another vehicle I can claim off my own fully comp insurance or do all the work myself. They said if I claimed off my own they wouldn't pursue the 3rd party to recover damages.

So the only option they gave me was to pay my excess and loose my no claims.
I think AF are very poor when it comes to claiming. Had another issue last year and took 3 months to get my car repaired.

Typical insurance companies will do everything to take your money then do nothing for it.

I am training VDA so deal with insurance claims all day everyday now and to be fair mate pretty much every insurance company will tell you the same, AF are just brokers, but cant see what they could do for you, don't think even the 3rd party accident management companies are going to take that sort of claim on, trying to claim against someone who wasn't in a car at the time is hard work.

I am not saying its right but its just how it is, I was left in a similar position a few years ago when the flat above me flooded my flat, coming from a vehicle repair background I couldn't work out why I had to claim on my own insurance and pay the excess to repair my flat when it was someone elses fault.

Don't ask me why but the whole fault none fault thing only seems to apply to motor insurance and unfortunately for you to try and claim against him you are not trying to claim against a motor insurance policy.

As above. Problem you have is insurance won't touch it because it costs money to instruct a solicitor to puruse such a claim against an individual in the absence of insurance to indemnify the third party. Basically even if you win actually extracting the monies will be time consuming and costly. You could get a solicitor to puruse the matter but most will be unwilling due again the above the issue of them realistically getting paid at the end of the claim. Might be best to speak to the owner directly and ask him to pay or get him to speak to his household insurance provider.

I agree with the other posts, the lack of 3rd part liability is the issue. It"s not right but the cost to pursue wouldn't make it a viable case.

Contacting the owner seems to be the obvious choice, hopefully he's a decent chap.

Or perhaps could you pursue this yourself through the small claims court?

Small claims court is the way forward, doesn't normally cost too much. Probably a little more than your excess and you can do it yourself rather than having to go through a solicitor. Also go to citizens advice, they are extremely helpful. Have patience with them and they cant do enough for you.
